Abstract：Research on historical source of institution of legislative interpretation helps to understand its rationality.The institution of legislative interpretation reflects the principle of people's democracy and collectivism.The people's congress system and social reality of lack of judicial independence are the institutional factors that create and support the institution of legislative interpretation.Despite of its defect，this institution shouldn't be abolished.It can play more important role after proper reform.
